Discussion Regarding the Status of the City's Emergency Operations Plan and Next Steps
That City Council discuss and provide input on the status of the City's Emergency Operations Plan and the next steps identified by staff.
DISCUSSION ITEMS
(1) Adopt Resolution 2026-111 a Resolution of the City Council of the City of Banning, California, Accepting the Riverside County Registrar of Voters Certificate of Sufficiency for the Referendum Petitions for Ordinance Nos. 1618, 1619, and 1620 Adopted by the City Council on April 14, 2026.
(2) Reconsider and Provide Direction to Repeal Ordinance Nos. 1618, 1619, and 1620.
a. Ordinance No. 1618 – amending the city’s zoning map from High Density Residential, Medium Density Residential, Low Density Residential, General Commercial, Open Space – Resources and Open Space – Parks land uses to the Sunset Crossroads Specific Plan that provides for General Commercial, Industrial, Open Space – Parks, and Open Space – Resources land uses.
b. Ordinance No. 1619 – amending the city’s zoning map to change the zoning of 41 acres of a 49.2 acre site within the jurisdiction of the City from Public Facilities School to Very High Density Residential to ensure “no net loss” of the City’s residential development capacity.
c. Ordinance No. 1620 – approving a statutory Development Agreement between the City and NP Banning Industrial (Owner). Under the terms of the Development Agreement and in exchange for vested development rights to develop a master planned project including industrial and commercial uses and various public facilities including parkland and open space, with on and off site related improvements on approximately 533.8 acres of Owners real property located within the City of Banning and the County of Riverside. The Development Agreement requires the Owner to provide fees, facilities, and public benefits subject to the timing and terms of the Development Agreement.
(3) If the City Council does not direct the repeal of Ordinances Nos.1618, 1619, and 1620, in their entirety:
a. Adopt Resolution 2026-112, Calling for the holding of a General Municipal Election on November 3, 2026, for the Submission to the Qualified Voters of the City of Banning, Ordinance Nos. 1618, 1619, and 1620; Request the County of Riverside to consolidate said election with the Statewide General Election on November 3, 2026; Request the Board of Supervisors to consent to the Registrar of Voters performing election services for the City of Banning; Setting rules and deadlines for arguments and rebuttals for and against each Ordinance.

Cannabis Warehouse Moratorium Discussion
Staff recommends the City Council discuss and provide direction.
Consideration of a fee waiver request by the Stagecoach Day's Association in the Not to Exceed amount of $38,000
That the City Council review the request and determine if they would like to approve a fee waiver of additional in-kind services for the Annual Stagecoach Day's Event.
Update on Utility Billing Recovery Efforts
Receive an update on the City’s utility billing recovery efforts and provide direction as needed. Staff also recommends temporarily deferring service discontinuance for customers who submitted a payment plan application that remains under review.
